In order to obtain a gaming license from the Pennsylvania Gaming Control Board (PGCB), DeNaples had to go through an extensive background check due to his previous legal troubles. He was eventually granted a license in 2006 and opened Mount Airy Casino Resort in October of 2007.

In 1978, DeNaples was charged with perjury for lying to a grand jury about his relationship with organized crime figures. The charges were eventually dropped, but in 1983 he was indicted on federal racketeering charges related to his garbage-hauling business. He ultimately pleaded guilty to a lesser charge and was sentenced to probation.

In 2008, an investigation was launched into whether DeNaples had lied to state gaming regulators about his alleged ties to organized crime figures. He denied the accusations and claimed that he had severed all ties with the individuals in question.

However, in 2009, he agreed to surrender control of the casino and pay a $1.5 million fine to settle the case. He later regained control of the casino in 2012 after reaching a settlement with the PGCB.
